yes that is true. I did not had any problem with mortgage. Atleast as of today, it is illegal to deny mortgage based on immigration status. If you have any idea of buying a house, it is better to do it before any law changes if at all there is one in the pipeline as you(madhuri) suspect.
It is all how you see your life. Just concentrate your energies on positive stuff you have. When we talk about fairness, we forget the fact that life is not fair. Instead of a division among ourselves, we should aim for a constructive approach otherwise this whole advocacy drive would be futile.

Sent in concurrent filing 1-140 & I-1485 on June 1st .
RD June 4th
ND June 5th
All checks cashed including PP for I-140 ON 2nd June 2007.
I have a couple of questions:-
How long before i get a answer on Premium Processing on I-140.
How long for Finger Printing notice.
How long before i get EAD.
Can i renew my CA drivers license with I-1485 filing receipt or do i have to wait for EAD.

I hope everyone is sending out the press release to their media contacts. As you all know, this event is not centrally co-ordinated and everyone has been really proactive in getting the word out.
Same goes for the media contact as well. No single person is emailing/faxing this information out - everyone is doing his or her bit.
Since most of the coverage will come from journalists local to the D.C. area, members there should be particularly aggressive in calling local newspapers, radio stations, tv stations etc.
Let's give this thing one big push.

I called my attorney today to inquire about this and he told me that one-third to one-fourth of the applications that he has filed in July are yet to receive the FP notices and he asked me not to worry about it.
Hope he is true and that we will be getting the FP notices soon.

I've no problems you or anybody else challenging me--we're all (mostly) scientists/engineers here, so making assumptions based on observations, and challenging them, should be the first step toward creating a hypothesis (http://en.wikipedia.org/wiki/Scientific_method). But science seeks evidence for those assumptions. Staying clear of traps like fallacies (http://en.wikipedia.org/wiki/Fallacy) should help.

If many EB3-I folks are getting GCs then why is EB3-I PD stuck in 2001? Shouldn't it move?
There are still lots of cases in eb3 from back that far.
Many of the eb3 245i cases; there dependents were outside USA. Once; they got greencards; then their dependents went for consular processing or are going for consular processing.
One of the cases I worked on ability to pay; person had adopted her nephew so that he could get greencard as dependent. You couldn't even begin to imagine how many cases like this there are.

i was not able to attend the IV rally..emergency reasons..but still its fair for me to suffer..
its highly unlikely we can see a reform. I agree with logiclife's post..we deserve what we are getting into..
of the 800K applications u saw applying for AOS..even if 10K had come to DC rally it'd made a huge diff..
we all do line up for GCs like herds but dont have the guts to attend..
i know of so many ppl who say "all this rally is ridiculous".. and i dont pity them those who wait for 10 years..becoz u deserve to suffer and will continually suffer..

Hi All,
I have to do the landing before june, 2008.
I have already used AP to enter US after my last trip to India. So IO at POE canada will know that I have pending 485. don't know how to handle this situation.
I am planning to do the landing in last week of may via Niagra falls. (toronto)
anyone with similar status done landing please share your experience.

I don't know how you have calclated that. As far as I remember seeing various threads on this forum, there are atleast 5-6K EB3 in 2002 and similar number in 2003 for India. Considering 2.5 number used per family I an guessing we need atleast 20-25K Green card numbers for EB3 to move beyond 2003. With just 3300 EB3 available per year, my guess is it'll take 4-5 years for cuttoff dates to go past 2003. I may be pesimistic, but this country's immigration system has taking all optimism out of our American dream...

I think you got culture and problems mixed up......
What you have listed are problems our country is facing right now.....
While speaking 100 languages, celebrating 100 festivals and learning same values that we, our parents and their parents believed in is really a culture......
Well, culture has tremendous impact on people. Looking at the state of our country, what have we become in last 63+ years? Major percentage of population still live under poor living conditions. We are one of the most corrupted countries in the world. Some people want to live in denial. Boasting about greatness that doesn't exist is of no use to the current and future generations. We have to make our country great by changing the conditions. In order to do that, first we need to acknowledge that there are serioous issues. Unless we all unitedly agree that the conditions are pathetic and will worsen, nothing is going to change.

I work for company A which sent me to client C through company B(Prefered vendor). After working with the same client for 1.5 yrs, transfered my h1b to company B(PF) due to issues with the pay with company A. Company A has deducted huge sum of money($4000) from my last months pay towards PERM filing(Still under process). Upon demanding them to reimburse my money saying that its against law, they r threatening me saying that based on non-compete agreement they will take legal action against me.
I am not actually aware of the clauses in the agreement. company B(PF) told me that it does not have any clauses in its agreement with company A prohibiting them from taking me.Though i requested company A to provide me a copy of non-compete, they said i signed with them, they haven�t. The company is located in NJ and not sure how non-competes work under NJ state law.
I am really frustated upon this blackmail and going thru lot of pressure. The amount is too big too leave and cannot afford to hire a lawyer in case they file suit based on non-compete. even if i had signed a non compete agreement how does it stand as it is conflicting the agreement which company a signed with PF saying the upon my termination of the emplyment with them, Pf can take me without any gap period... what can i do to get my money. they also refused to provide me with experience letter which i need for my future GC filing.
Plz give me ur valuable inputs
I just read first page of this thread and would advice that don't follow most of reply because they are lawyers or they have not gone through the experience you are going through. $4000 may not be big amount compared to hassle of law suite , piece of mind or the amount of increase you may have received by switching employer. I know a close person who had gone through exactly same situation in NJ and had to pay 12,000 to settle the case. I have seen bunch of people in same situation and my friend always adviced them to stay away from law suite. If your current employer is not big then there are greater chances that it will turn away from you in case of law suite.
If you are not working with same client that you were working when you were in company A then non-compete may not hold against you.
Also can you get in writing from you current employer that they will support you in case of law suite?

am always puzzled how H1B is valid also for outsourcing the h1b-employee to another company (like sub-sub-.....sub-contracting) ?
wasnt h1b intended for a inhouse job rather than a job at a client company ?
h-1 by its nature is a temporary job when it was created (it was not dual intent where you could apply for permanet residency). Law is very clear in H-1b that you can be considered the employer (workig at your location or under your direction and control at a client location (pure consulting). OR you can be a staffing agency and outsource employee at a third party location. In this situaiton you are considered a "token" employer and only pay the person. Direction and control come from the place where you are actually working. This is where it gets difficult. Even if you are working at an end client; it is difficult to satisfy uscis these days because the evidence they are requesting; people cannot get it legitamately from many of the end clients.
In some of the various proposals; lawmakers are trying to kill EB based greencard and h-1b for IT people by getting rid of staffing. Staffing companies have historically been the feeder system into the country. Get rid of the feeder system then whole h-1b for IT collapses. People getting h-1b would mainly F-1 students.
